White House Has Not Approved the Ethics Provision

According to a Crypto in America report, the White House has not yet signed off on the ethics language included in the CLARITY Act.

This remains the case despite President Donald Trump’s recent meeting with Republican senators to discuss the crypto legislation. Sources cited in the report said the administration has not clearly explained which ethics restrictions it would support.

As a result, lawmakers may need more time before they can release an updated version of the bill.

The ethics provision has become one of the biggest barriers to progress. Democrats want stronger rules designed to limit potential conflicts between public officials and cryptocurrency businesses.

Democrats Raise Concerns About Trump’s Crypto Activity

Democratic lawmakers have increased pressure for tighter ethics protections following reports about Trump’s cryptocurrency-related income.

According to the original report, the president’s financial disclosure indicated that he earned as much as $1.4 billion from crypto-related activities during the previous year.

Senator Elizabeth Warren has also requested an updated financial disclosure from Trump. She argued that the information is necessary while lawmakers consider possible conflicts of interest within the crypto industry.

Democrats have reportedly complained that Republicans have not properly included them in recent negotiations. This includes discussions connected to the White House meeting held last week.

Without Democratic support, securing enough votes for the CLARITY Act could become more difficult.

Senate Faces Pressure Before August Recess

Lawmakers are now racing against the clock as the Senate prepares for its August recess.

The Senate majority leader has expressed interest in holding a floor vote before August. However, he acknowledged that Republicans and Democrats have not yet reached a bipartisan agreement.

This uncertainty has weakened confidence that the crypto bill will pass in the near future.

Polymarket data cited in the report showed only a 31% chance that Trump would sign the CLARITY Act into law before the end of 2026.

Prediction-market odds can change quickly and do not guarantee a political outcome. Still, the decline reflects growing concerns about the legislation’s progress.

DeFi Protections Create Another Major Dispute

The ethics language is not the only issue slowing down the CLARITY Act.

The Blockchain Regulatory Certainty Act, also known as the BRCA, has created additional disagreement among lawmakers, law enforcement groups and cryptocurrency organizations.

The provision is designed to protect developers who create decentralized finance platforms and other non-custodial blockchain services.

Under the proposed rules, developers would generally not be held responsible for the activities of people using their software. They would also not automatically be classified as money transmitters.

Crypto industry supporters argue that these protections are necessary because software developers do not always control how decentralized platforms are used.

However, law enforcement organizations have warned that the provision could make it more difficult to investigate money laundering, fraud and other forms of illicit finance.

Blockchain Association Expects DeFi Language to Remain

Blockchain Association CEO Summer Mersinger said she expects the BRCA provision to remain in the updated Senate version of the bill.

She also suggested that a floor vote on the CLARITY Act could still take place soon.

Despite the remaining disagreements, Mersinger expressed confidence that lawmakers may eventually gather enough support to pass the legislation.

However, the timing remains highly uncertain. The Senate must resolve concerns surrounding ethics, decentralized finance and bipartisan participation before the bill can move forward.

What the CLARITY Act Could Mean for Crypto

The CLARITY Act is intended to provide a clearer regulatory framework for cryptocurrencies and other digital assets in the United States.

Supporters believe the legislation could reduce uncertainty by defining the responsibilities of financial regulators and establishing clearer rules for crypto companies.

However, disagreements over political ethics and DeFi protections have complicated the process.
